Schreiber seeks bail while he awaits extradition

German-Canadian businessman Karlheinz Schreiber was to be in court Monday seeking release from a Toronto detention centre where he’s been held while he awaits extradition.

Crown prosecutors are expected to argue against granting bail to Schreiber, who is wanted in Germany on charges of fraud, tax evasion and bribery.

For eight years, he has waged a legal battle to remain in Canada. Earlier this month, however, the Supreme Court of Canada dismissed Schreiber’s request to appeal the extradition order.

Despite that outcome, Schreiber will stay in Canada for the immediate future following a decision by federal Justice Minister Rob Nicholson to allow him to remain until he testifies at a public inquiry into his dealings with former prime minister Brian Mulroney.

Meanwhile, Folco Galli, a spokesman for the Swiss Ministry of Justice told the Associated Press that Swiss authorities have now decided to allow Germany to use bank documents it secured from Switzerland in 1999 in the case against Schreiber.

It had blocked the use of bank documents on suspicion that Germany was only interested in uncovering tax evasion.

Tax evasion is only an administrative offence in Switzerland, which does not provide juridical assistance to other governments investigating alleged abuses. It does, however, provide help in cases of money laundering, bribery and other felonies.

    The reason I posted this entry was because I thought this guy was out on bail. The media made a huge deal of it at the time.

    When did he go back in the slammer?

    Jack:

    I assumed the same as you, that he was out on bail. But I did a little research. The terms of his bail, granted prior to his testimony to the ethics committee, required him to re-enter custody the day before the SCC ruled on his most recent application for a review of his extradition. And the SCC ruled against him not too long ago. As I understand the situation now, he may have difficulty getting bail again, because apparently he is only entitled to apply for bail if he has a matter pending before the courts. And he appears to have exhausted all of those.
